Pool will be plastered within sixty (60) business days from the commencement of excavation, but this timeline applies exclusively to designated pool models. In the event that plastering is not completed within sixty (60) business days following the start of excavation, a credit of one hundred dollars (US $100) per day will be applied to the total cost of the pool, up to a maximum of one thousand dollars (US $1,000). A&S will make reasonable and good faith efforts to obtain all necessary building permits, homeowners’ association (HOA) approvals, and any other required permissions from state, local, or municipal authorities. The customer agrees to cooperate in securing such approvals. Excavation will not begin until all required permissions have been obtained. A&S reserves the right to cancel this Agreement if, through no fault of its own, the required permits and state, local and municipal approvals are not obtained within ninety (90) days from the date of this Agreement. A&S shall not be held liable for construction delays caused by circumstances beyond its control, including but not limited to acts of God, inclement weather, labor strikes, governmental actions, modifications to the Agreement or its addenda, vandalism, shortages of materials or labor, or delays caused by subcontractors, suppliers, the customer, the customer’s agents, or third parties.
